Court of Protection

Home / Wills and Probate / Court of Protection

The Court of Protection is there to ensure that vulnerable people who lack capacity are protected.

Should you have not made a Lasting Power of Attorney and you lose mental capacity no one will legally be able to make decisions on your behalf without a Court Order.

If you need to assist someone whose mental health has declined, we are here to help you with these steps.

We can assist with the necessary paperwork and procedures to make an application to the Court of Protection.

Once an application is made by an individual the Court will consider whether they feel it is appropriate for them to be appointed.

If appointed as a Deputy, you will then be able to deal with the finances of the person lacking capacity to ensure their day-to-day needs are met.

If you wish to discuss the role of deputy, please do not hesitate to contact us for further information.
