What is a no-fault divorce?

A no-fault divorce allows you to end your marriage without blame being placed on either party. This means you no longer have to prove adultery, unreasonable behaviour, or any other fault grounds, which can often make the process more stressful and contentious. Instead, you simply need to confirm that your relationship has irretrievably broken down.

Since the introduction of no-fault divorce laws in April 2022, divorces in England and Wales have become less stressful, and more amicable, without the need to engage in any conflict or blame.

What are the benefits of a no-fault divorce?

• No blame, no conflict: There is no need to assign blame or argue about past actions, making the process more amicable for both parties.
• Less Hassle: With no need to present evidence or prove fault, the divorce process runs more smoothly.
• No contesting: Under the new law, divorces are no longer contestable, meaning neither party can prevent the divorce from going ahead, providing both of you with certainty and peace of mind.
• More control and flexibility: You can apply for a divorce together (please seek advice) or one party can initiate it, offering you flexibility in how the process unfolds.
• Reduced stress: The no-fault divorce process is designed to reduce emotional and financial strain, allowing you to move forward with your life.

This solution is not suitable for everyone.  

However, when separating couples have already reached an agreement over key issues such as finances and child arrangements, this highly cost-effective option can be implemented to bring the relationship to a legal conclusion.

Less paperwork, fewer meetings and, crucially, no court appearance.
