Why January is the peak month for divorce enquiries

As routines return to normal following the Christmas break, the Family team at ORJ is preparing for what has become known as ‘Divorce Day’.

Occurring on the first working Monday in January, the day traditionally sees a spike in enquiries from people considering separation or divorce.

While it has been hyped up by the media over the years, there is undoubtedly some truth in it – and there’s various reasons why.

Some couples may have decided to separate some time ago but opted to wait until after Christmas to start legal proceedings, often for the benefit of children. For others, the excesses of Christmas – and spending more time together – might have proved the final nail in the coffin for an already under strain relationship.

January also represents a symbolic fresh start, with many people reassessing their happiness and long‑term goals. Combined with post‑holiday financial stress and a return to the mundane, unresolved issues often come sharply into focus.

Some statistics show that divorce enquiries surge by around 25% in January – and more often than not it is initiated by wives in opposite-sex marriages. While the figures are not quite that stark at ORJ, we do see a notable increase during the first months of the year.

The only time to buck this trend was during the covid pandemic, where lockdowns and court disruptions changed the divorcing landscape. January 2025 demonstrated a return to the established pattern, however – and it would be very surprising if 2026’s opener doesn’t follow suit. 

Although enquiries rise significantly, official divorce filings remain consistent throughout the year. This shows the January spike reflects intention to seek clarity, not impulsive decisions.

The introduction of no‑fault divorce has further simplified the process, helping couples navigate separation with less confrontation. Early legal advice remains crucial to understanding finances, children’s arrangements and the steps involved.
